Incoterms 2010
Incoterms 2010 are international rules recognized by governments, law firms and merchants around the world as the interpretation of the most applicable terms in international trade.
The edition entered into force on January 01, 2011.
Incoterms 2010 are international rules recognized by governments, law firms and merchants around the world as the interpretation of the most applicable terms in international trade.
The scope of Incoterms 2010 applies to the rights and obligations of the parties to the contract of sale in terms of delivery of goods (terms of delivery of goods).
Here is a complete list of Incoterms 2010 terms and the necessary comments to them.
- Terms and conditions: DAP and DAT: In Incoterms 2010 the number of terms was reduced from 13 to 11. However, two new provisions (DAP — delivered at place, and DAT — delivered at terminal) have been introduced, which can be used as multimodal. The four least practiced terms were eliminated (DAF, DES, DEQ, and DDU).
- The term DAT (delivery to terminal) replaces the term DEQ: the goods are placed at the disposal of the customer unloaded from the arriving vehicle. DAT as opposed to DEQ is applicable to multimodal transportation. According to logistics experts, delivery to the DAT terminal corresponds most closely to port logistics practices.
- The term DAP (delivery to point) is a common provision where it is important to specify the exact destination. The term DAP supersedes the following three terms: DAF, DES, DDU, as well as stipulates that the goods are provided to the customer being ready for unloading (in our conditions — for transfer under customs surveillance, or for customs clearance).
- New costs and risks in FOB, CFR and CIF: in FOB (free on board), CFR (cost and freight) and CIF (cost, insurance and freight) delivery terms, costs and risks are set in a new way. In Incoterms 2000 under these three conditions of delivery risk passed upon delivery to the vessel, while in Incoterms 2010 the transfer of risk is carried out after full loading of the cargo on board the vessel (allocation of responsibility and transfer of risks in Incoterms 2000 see below).
Incoterms 2010 structure:
- Group E: the seller's obligations are minimal and limited to placing the goods at the customer's disposal;
- Group F: the seller's obligations are limited to dispatching the goods and the seller has not paid for the primary transportation;
- Group C: the seller arranges and pays for the transportation without assuming the risks involved;
- Group D: the seller's costs and risks are maximized because of the obligation to place the goods at the disposal of the customer at the agreed destination (ensure arrival).
Within the groups, the main liabilities do not differ significantly. For example, in Group C under CIF and CIP bases, the seller must additionally insure the goods, and in Group D under DDP condition — to pay import duties. Within Groups F and D there are differences related to loading (unloading).
